Intellectual Property Policy

Built Bezel is a marketplace for genuine pre-owned watches. The resale of genuine branded goods does not infringe trademark rights under the principle of exhaustion of rights (Trade Marks Act 1994, s.12). However, the sale of counterfeit goods is a criminal offence under the Trade Marks Act 1994 and the Fraud Act 2006.

We take all IP complaints seriously. Brand owners and rights holders may submit takedown notices as described below.

If you are a brand owner or authorised representative and believe that a listing on Built Bezel infringes your intellectual property rights (e.g. selling counterfeit goods under your trademark), you may submit a takedown notice to contact@builtbezel.com with the subject line “IP Takedown Notice”.

Your notice must include:

• Your name, company name, and contact details.
• Identification of the IP right you own or represent (e.g. registered trademark number, brand name).
• The URL(s) of the infringing listing(s) on Built Bezel.
• A description of why you believe the listing infringes your rights.
• A statement that you have a good-faith belief that the use is not authorised by you, your agent, or the law.
• A statement that the information in the notice is accurate and, under penalty of perjury, that you are authorised to act on behalf of the rights holder.
• Your electronic or physical signature.

Incomplete notices may not be acted upon.

We aim to respond to all valid takedown notices within 5 business days. Upon receiving a valid notice, we will:

1. Review the listing and the notice.
2. Where the complaint is credible, temporarily remove or disable the listing pending investigation.
3. Notify the seller that their listing has been subject to a takedown notice (unless there is a legal reason not to).
4. Allow the seller the opportunity to submit a counter-notice (see section 4).
5. Communicate the outcome to the complainant within the 5-day window.

We may request additional information if the notice is unclear. Abusive or bad-faith notices may result in the complainant being banned from submitting future notices.

If you are a seller whose listing has been removed following an IP takedown notice, and you believe the removal was in error, you may submit a counter-notice to contact@builtbezel.com with the subject line “IP Counter-Notice”.

Your counter-notice must include:

• Your name and contact details.
• Identification of the listing that was removed.
• A statement that you have a good-faith belief the listing was removed as a result of mistake or misidentification.
• Evidence supporting your counter-notice (e.g. proof of purchase, authentication certificate, photographs).
• A statement that you consent to the jurisdiction of the courts of England and Wales for any dispute with the complainant arising from the notice.
• Your electronic or physical signature.

We will forward the counter-notice to the original complainant and allow them 10 business days to respond. If no response is received, we may reinstate the listing at our discretion.

Built Bezel operates a strict repeat infringer policy. Any seller who receives two or more valid IP takedown notices (that are not successfully counter-noticed) within a 12-month period will have their account permanently banned from selling on the platform.

We may also report repeat infringers to relevant authorities including Trading Standards, the Police Intellectual Property Crime Unit (PIPCU), and brand owners' legal teams.
